Privacy Policy

Welcome! Please read this Privacy Policy carefully before using our Platform.

This Privacy Policy explains how Delivery Rewards LLC DBA Order Pass and its subsidiaries and affiliates (“Order Pass”, “we”, “us” or “our”) collect, use, disclose, and otherwise process personal information in connection with our Platform. Out Platform includes: 1. Our websites, such as; 2. Online services and in-store kiosks; 3. Any other programs, tools, properties or technology now or in the future; in each case, that reference this Privacy Policy.

This Privacy Policy does not cover or address the privacy practices of Restaurants and their partners, franchisee systems or authorized licensees. Any undefined terms in this Privacy Policy, has the definition specified in our Terms of Use.

By accessing or using this Platform, website, app or software, you agree that you have read and understood and agree to our collection, storage, usage and disclosure of your personal information as described herein this Privacy Policy and also in our Terms of Use.

1. Personal Information We Collect

1.1. Data provided directly by you

Your Profile and Contact Information. When you create an Account, Place an Order, or enter any information on our website such as your e-mail address, phone number, physical address, billing information – the information you enter will be used to: (1) Creating a personalized Account for use the Platform; (2) Using the information to process orders and fulfill order data; (3) Share information with store/business ordering from or receiving parties of orders for the purpose of fulfilling the order and reporting purposes; (4) Communicating with you directly about your services, issues, concerns or other users may have. (5) Send you marketing communications based on your Account preferences; (6) Fulfill and complete your order including passing data to Restaurants and their partners.

Payment Information. Payment information is required when submitting orders on our Platform. The payment information required include credit card, debit card or gift card details. The payment information is used to complete the transaction, fulfill your order and detect and prevent fraud and abuse of our system. In addition, your payment information may be stored in order to allow for faster future checkouts should you decide to store your payment details during check out.

Transactional Information. When you submit an order, we will collect information including transaction details, billing details used to pay for the order, products purchased, date and time of transactions, amounts, comments, point or reward program qualification data that you may redeem as part of our loyalty or rewards program. The transaction details we collect are used to fulfill your order, allow for verification of the order, update your rewards and loyalty information, detect and prevent fraud or fraudulent activity, personalize your browsing experience, keep our advertising and marketing informed, identify usage trends and patterns with data analytics tools.

Communications, Participations and interaction with content. We record any information you provide us when responding to surveys, entering contests or sweepstakes or taking part in any promotions we run. We maintain all information resulting from our communications from your direct or indirect interactions with our Platform. We maintain your data, information, ratings and reviews regarding products or restaurants on our Platform which we will use to post publicly on our platform for the benefit of all users.

Aggregating Personal Information. Aggregating personal information allows us to use your information and create a purposeful use that does not uniquely identify you or any other user on out Platform. The purposeful uses may include marketing, advertising, analytics, demographic profiling, geo targeting, research, analysis and other business purposes.

1.2. Personal Information Generated and Automatically Collected During Use of our Platform

Your Device and Software Information. We may record, maintain and use information regarding your device and its software including data such as Your IP Address, Internet Service Provider, Device Type, Device Model, Device Brand, Unique Tracking Numbers, Device ID, Date and Time Stamps, Account ID, Mobile AD ID and any other similar information for the purpose of using information for internal purposes or third partner tools such as for advertising, analytics, data analysis, platform improvements, feedback, suspicious activity detection and mitigation, and user experience improvement purposes.

Accessing and Using our Platform. The way you use our services provides key insights into the behaviors and patterns of our users and provides insightful data for the purposes of running advertising campaigns based on usage patterns on the Platform such as where you entered the Platform, what page you exited from, how long you visited a particular page, which pages you visited and how often you revisit or reorder from the platform including past order history and all interactions with the Platform. The data that is generated is used and collected by our system for the purpose of custom tailoring our system, advertising, system improvements, experience improvements, evaluating marketing and advertising performances and to send you further communications and marketing offers.

Third Party Analytics Used. We use third party analytics tools such as Google Analytics to help us measure website traffic, user trends, demographic data and ability to perform remarketing campaigns. You may learn more about Google’s practices at:

Location Information and Data. We use your location information in order to provide you service on our Platform, customize our content, order fulfillment, suspicious activity detection and mitigation, fraud detection and prevention, showing relevant restaurants, showing relevant offers or communicating relevant information based off of your location, analytics, trends, marketing, advertising and reporting. Your location information is collected in multiple ways including 1. You willingly providing us with the said data 2. We may use third party such as Google Maps or Bing Maps to determine your location from GPS, IP Address, Cell Phone Towers, Wifi signals (see Google Maps and Bings Maps privacy policy and terms of service to learn more) 3. In other instances we may collect your location information from GPS coordinates, wireless networks, Wifi signals and information based off of your IP address utilizing third party partners.

Tracking Technologies. We or third-party partners automatically collect data through tracking technologies utilizing technology such as cookies, web beacons, web objects, scripts, website URL address appended strings, location identifying technologies collectively known as Tracking Technologies. We use third party tools to assist us with these efforts and use and aggregate the information for the purpose of providing (1) customizing our website and platform content (2) Remember your user settings and preferences and entered saved form values (3) detecting and prevent suspicious, malicious or fraudulent activity (4) detecting, analyzing for the purpose of platform upgrades and enhancements (5) marketing, advertising and monitoring the effectiveness of those campaigns including tracking conversions and interactions on the Platform.

1.3. Data from other sources

Third Party Site Information Exchange. Our Platform may use third party features such as allowing you to login with your social media username and passwords, sharing to your social media channels. Your interaction with any third party features results in data collection through the third party. Your privacy settings on the third party website will dictate what information may be accessible by our Platform including name, e-mail address, contact information, contacts, phone number, birthday and any other personal information you may have provided to the third party.

We do not supervise, control or respond to how third parties providing your information process your personal information and any other disclosures regarding your personal information, such requests should be directed to the third parties directly.

2. How We Use Your Personal Information

In addition to the uses we described above, we may also collect and use personal information for the following purposes:

2.1. Provide, Collect, Maintain, Improve, Develop Platform and Services. For example, we may use your personal information for:

  • Enable you to create an account, login to your account, remember information about your visit so you do not have to re-enter the next time,
  • Fulfill your order request and process payments (e.g., allowing you to order from Restaurants and having the food delivered to you based on the information we have collected or to provide you with information that you have requested),
  • Perform analytics, trend tracking, usage history for use in our advertising, marketing and/or for use of improving our Platform.
  • Provide personalized and custom content based on your usage and personal information (e.g., showing “restaurants near me” and/or popular restaurants that may interest you based off of your past purchases)

2.2. Safety maintenance, stability and security of our Platform. We may use your personal information in helping us improve the safety and security of our platform. For example:

  • Detect and counter fraudulent activity and user behavior,
  • Diagnose and fix technology related problems,
  • Perform security measures and risk assessments,
  • Improve security measures and performance.

2.3. Personal Information Communication. We may use your personal information to communicate with you about important messages, your order information or your account. For example, we might send you emails or messages about account verification, updates to our Platform, security notices and other marketing communications from or about Order Pass.

2.4. Provide, personalize, analyze and improve our advertising and marketing. We may use your personal information for improving our advertising and marketing. For example, we:

  • Inform you about our product and communications we believe may interest you including but without limitation emails, text messages, messages, push notifications and ads.
  • Determine the effectiveness of our marketing program and promotions campaigns
  • Identify and contact you across multiple devices

2.5. Regulatory and Legal Requirements and Proceedings. Your personal information may be used in order to comply with legal and regulatory requirements and proceedings. For example, we may use your personal information to enforce corporate or government reporting obligations or to comply with any applicable laws.

2.6 Enforcing our rights. By using our Platform and services provided, you are bound by our Terms of Use and Privacy Policy. We try to ensure every user complies with our rules and policies and in that pursuit we may collect, investigate, monitor, help prevent or mitigate violations of our Terms of Use as well as enforce any other agreements we may have with business partners or third parties.

2.7. Other purposes disclosed during time of collection. At any time, we may use your personal information for other purposes not contemplated in this Privacy Policy, if such as instance occurs, we will specifically disclose that use to you.

3. Our Sharing and Disclosure of Personal Information

We disclose personal information to the following types of third parties:

3.1 Restaurant sharing. We will disclose personal information to the Restaurants which you place an order from or have placed an order from in the past or any third parties engaged or hired by those Restaurants (e.g. point of sales systems, rewards programs, delivery drivers, accountants) as needed to fulfill your order, process your order, fulfill any reporting obligations, communications about cancellation or delays in your order processing and communication regarding any credit card charge backs.

3.2. Other Third Parties necessary to fulfill your order. In addition to Restaurants you order from, we disclose your personal information to other third parties necessary to process your order, including, without limitation, payment processors, delivery providers, e-mail, ISP providers and web hosting.

3.3. Service providers and contractors. We disclose your personal information to third parties that provide service for us or on our behalf such as IT services, website hosting, data analysis, email delivery systems, fraud detection systems, security monitoring, advertising, marketing and other similar services.

3.4. Analytics Providers and Collection. We will share your personal information with analytics provider in order to help improve our system, monitor user interactions, monitor usage behaviors and patterns and for the purpose of monitoring our Platform for improvements, abuse and optimizations.

3.5. Advertising, Marketing and Promotions providers. We share personal information with third parties that we employ to run co-marketing activities, customized marketing campaigns, launch promotions or similar advertising efforts. For example:

  • Promotional and Marketing Partners. We may disclose your personal information to third party sponsors of promotions, contests, sweepstakes and any other joint or co-branded promotional or marketing activity. You should carefully review the rms of use of every promotion which you decide to participate in as those promotions may contain additional information about how your personal information is being used by us or other third parties.
  • Advertising networks and advertising partners. We use third party advertising networks to help deliver personalized ads and content on our Platform, other websites, apps and across devices you may use. These third parties will collect information directly from you automatically including your device, browser, cookies and other tracking technologies. The collection information is used to determine the effectiveness of our advertising and marketing and allows us to conduct attribution and other marketing research and coordination.
  • Search and Social Networks. We disclose personal information to Search and Social Media companies and their partners for the the purpose of displaying personalized advertising campaigns on those Platforms, tracking performance of marketing and advertising campaigns and providing attribution for sales or user actions taken on out Platform. The personal information collected will include name, phone number, unique identifiers, email, IP address and other data collected through our tracking technologies or the tracking technologies of the Search and Social Networks automatically.
  • Select Restaurants and Brands. We disclose your personal information to select Restaurants and Brands which you may have placed an order with through our platform or engaged with their content on our Platform. These Restaurants, brands and their affiliates, partners may use your personal information to contact you about marketing communications or other promotional content.
  • Affiliate Sharing. We share your personal information with other companies owned or controlled by Order Pass and companies by or under common ownership its subsidiaries or any companies that may own or control us directly or indirectly.

3.6. Public. Our platform enables common social features such as posting reviews, photos, profile pictures, ratings, chat and messaging. Please do not disclose your personal information on any of these features as they will become public. Any information you provide in connection with our Platform or Service may be available to the visitors of our Platform or to the general public. We encourage you to use discretion and caution when disclosing any information with these features.

3.7. Business Transactions and Reorganization. Our business may take part in a business transaction such as an acquisition, merger, sale, joint venture or sale of all or portions of our company assets. We may disclose personal information to third parties during such negotiations or business transaction. Personal information may also be disclosed during legal proceedings such as insolvency, bankruptcy and receivership.

3.8. Legal Obligations and Rights. We disclose personal information to third parties such as law enforcement, legal advisors or as required by law or subpoena or if we feel that such action is necessary to (1) protect safety of Order Pass visitors or customers, (2) detect, suppress or mitigate fraud, (3) comply with the law or reasonable requests of law enforcements.

3.9. Consent. We may disclose your personal information about you to third parties with your consent.

4. Control Over Your Personal Information

Profile Settings. You may update your profile information in the “My Account” section of the service.

Device Information and Notifications. You may opt out of any notifications received on your device through your device settings or app settings. Example, you may remove location tracking in your device settings, however we may still use your IP address and other information to approximate location in order to enable features on our Platform such as nearby restaurant discovery.

Controlling Your Communication Preferences. You may unsubscribe from any marketing communications by clicking the “Unsubscribe” links in your promotional and advertising material received via e-mail. You may opt-out of promotional text messaging by replying “STOP” to the numbers sending those messages. You may not unsubscribe from service related communications such as password reset requests, account creation e-mails, order confirmations, technical information, security notices, or any other notices we pay post.

5. How We Store and Protect Your Information

Data storage and transfer. We may transfer your data and personal information to countries and jurisdictions that do not have the same data protection laws as your jurisdiction. The information we collect, store and process are conducted in the United States.

Information Safety. We care about your privacy and do our best to employ reasonable technology to safeguard data, however, no security system is impenetrable and we cannot guarantee the security of our systems or those who use it. Protecting your personal information is your responsibility as well and must be taken seriously. We recommend using a strong password, changing it often, securing your devices and browsers and consulting with a security professional should you have any doubts. 6. Children’s Personal Information

We do not intend to, or knowingly collect or solicit information from children under the age of 13. In the event we learn we may have inadvertently collected personal information from a child under the age of 13, we will delete that information as quickly as possible. We are not responsible for any personal information practices of third-party websites and online services or practices of other third parties. 8. Updates to This Privacy Policy

We will update this Privacy Policy from time to time. When we do make changes to this Privacy Policy we will change the Effective Date at the beginning of this document. All changes become effective from the Effective Date posted. If you do not cancel your account before the Effective Date or revised Privacy Policy goes into effect, you continued use or access of our Platform and services will be subject to the revised Privacy Policy.
